E Cigarette a Scam?

Advertising introduction:

"It looks like a cigarette, it tastes like a cigarette, it feels like a cigarette, but it isn't a cigarette, it contains no tobacco, and the 'smoke' is vapor."

But beware! If you go to one of these websites - Smoking Everywhere - or their "sister site," where there is  "Risk Free Trial" advertised at least 3 times, the E Cigarette may hurt your bank balance more than you expect.

This is the complaint I received from a customer of theirs.

I am disputing all charges made to my account by Smoking Everywhere LLC, Sunrise, Florida.

I registered on their website http://www.ifreetrial.com/ for a Free trial offer on 9/17/09.

First charge was on 9/18/2009 for $9.95. I didn't realize this until later, when my credit card statement arrived.

I canceled the order on 10/09/2009

Second charge was on 10/14/2009 for $99.02, (this was before they shipped my "free trial offer" and after I had canceled.) 

I received a short email with my order number, 9/17/09, and nothing else, no shipping date or anything. 

I emailed Smoking Everywhere on 10/9/09 to cancel this order as I had never given them authorization to charge me $9.95 or anything. 

I attempted to call them twice to make sure the order was cancelled, but they would not answer the calls.

They called me a few days later and said my order was ready to ship, I informed them that I had canceled the order and again canceled the order. 

On 10/20/09 they shipped a box to me.

There are no terms and conditions for the free trial on the main Smoking Everywhere website. But there are terms and conditions on the sister website (see above), in very faint text at the bottom, which I didn't see at all.  It is placed deceptively and is very hard to read.

Free trial text I copied on 11/2/09:
The 14 day trial offer is designed to display the quality and effectiveness of the Smoking Everywhere E-Cigarette product. This gives you the opportunity to try Smoking Everywhere E-Cigarette during a 14 day trial period. You can come to a decision for yourself if this is the right product for you.

The 14 day trial period starts on the day you place your order and includes processing and transit time. Upon ordering, you agree to pay the non-refundable $9.95 shipping and handling fees for the free trial offer. Unless you call customer support to cancel before the end of the 14 day trial period, you will be charged a discounted price of $99.02 automatically. By accepting this Free Trial, you will also be enrolled in the Cartridges Refill Autoship Program. After the 14 days from your free trial order date and every 30 days thereafter you will be sent 35 cartridges (7 packs) which equal to 30 day supply of Smoking Everywhere E-Cigarette and the form of payment that you used to order the trial will be billed the Member's Only price of $49.99 which includes the shipping and handling for the monthly supply.

You are not obligated to purchase after you receive your free trial of Smoking Everywhere E-Cigarette and you can cancel any time before the end of the 14 day trial period.

Lies:  They claim the 14 day free trial starts on the day I order, yet on the invoice they say my card will not be charged if the item is not returned within the free trial period. 

How can a 14 day free trial end before they even ship the item?  How can I return an item I have not received?

On the invoice they sent it says,

This is a Free Trial item for the duration of 14 days.  This item must be returned within the 14 days trial.  Your credit card will remain on file, and be charged only if this item is not returned within the trial period.  Pay only $9.95 shipping and handling fee and your Gold One kit will be delivered to you on a 14 days FREE trial period.

So try to find "terms and conditions" on all websites. Be wary of "Free Trials" or similar. Be aware that you may be enrolled into an expensive monthly payment plan as a "member" without you realizing it.

There are better ways to quit smoking.
