E Cigarette a Scam?

cigarette, it tastes like a cigarette, it feels like a cigarette, but it
isn't a cigarette, it contains no tobacco, and the 'smoke' is vapor."
But beware! If you go
to one of these websites - Smoking Everywhere - or their "sister site,"
where there is "Risk Free Trial" advertised at least 3 times, the E
Cigarette may hurt your bank balance more than you expect.
This is the complaint
I received from a customer of theirs.
I am disputing all charges made to my account by Smoking Everywhere LLC,
Sunrise, Florida.
I
registered on their website
http://www.ifreetrial.com/ for
a Free trial offer on 9/17/09.
First charge was on 9/18/2009 for $9.95. I didn't realize this until later,
when my credit card statement arrived.
I canceled the order
on 10/09/2009
Second charge was on 10/14/2009 for $99.02, (this was before they
shipped my "free trial offer" and after I had canceled.)
I
received a short email with my order number, 9/17/09, and nothing else, no
shipping date or anything.
I
emailed Smoking Everywhere on 10/9/09 to cancel this order as I had never
given them authorization to charge me $9.95 or anything.
I
attempted to call them twice to make sure the order was cancelled, but they
would not answer the calls.
They called me a few days later and said my order was ready to ship, I
informed them that I had canceled the order and again canceled the order.
On 10/20/09 they shipped a box to me.
There are no terms and conditions for the free trial on the main Smoking
Everywhere website. But there are terms and conditions on the sister website
(see above), in very faint text at the bottom, which I
didn't see at all. It is placed deceptively and is very hard to read.
Their terms of use is clearly designed to screw me. The "free" 14 day trial
is only for the first 14 days after my ORDER, not 14 days after I receive
the product. However, in their email I received on 9/28/09 they state that
my free trial is for 14 days from when they ship the product, which
was 10/20/09. I shipped it back on 11/2/09, only 12 days later, and I
shipped it back unopened before the 14 days was over.
